Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the ClaimScout mobile application and the tryclaimscout.com website (together, the "Service"), operated by ClaimScout ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What ClaimScout Is — and Is Not

ClaimScout is an information and discovery tool. We collect publicly announced class action settlements and investigations from public sources, summarize their key details (deadlines, estimated payouts, proof requirements), and link you to the official settlement administrator's filing page.

ClaimScout is not a law firm, does not provide legal advice, does not represent you in any legal matter, and does not prepare, review, or submit claims on your behalf. Nothing in the Service constitutes legal, financial, or tax advice. If you need legal advice about a settlement, consult a licensed attorney.

3. No Guarantee of Eligibility or Payment

Eligibility for any settlement and the amount and timing of any payment are determined solely by the settlement administrator and the supervising court — never by ClaimScout. Payout figures shown in the Service are estimates drawn from public settlement documents and may change. We do not guarantee that you qualify for any settlement, that any claim you file will be accepted, or that you will receive any payment.

4. Independence

ClaimScout is independent. We are not affiliated with, endorsed by, or acting on behalf of any settlement administrator, court, law firm, or defendant company referenced in the Service. Company names and logos are used solely to identify the settlements they relate to and remain the property of their respective owners.

5. Eligibility to Use the Service

You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority where you live) to file settlement claims or purchase a subscription. If you are under 18, you may use the Service only with the involvement of a parent or guardian.

6. Accounts and Sign-In

You may browse without an account. To sync saved claims across devices, you can sign in with Apple or Google. You are responsible for the security of your sign-in credentials and for all activity under your account. You may delete your account at any time from the Account screen in the app, which permanently removes your ClaimScout account and synced claim data.

7. Your Responsibilities When Filing Claims

When you file a claim through a settlement administrator's page, you are submitting it directly to that administrator — not to us. You are solely responsible for:

8. Subscriptions, Billing, and Auto-Renewal

Parts of the Service require a paid subscription (weekly or yearly). Subscriptions are billed through your Apple ID, and prices are shown in the app before purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your Apple ID subscription settings; canceling stops future renewals but does not refund the current period. Refund requests are handled by Apple under Apple's media services terms. Deleting your ClaimScout account does not cancel an Apple subscription.

9. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose, including filing fraudulent claims; (b) scrape, copy, or redistribute the Service's content at scale; (c) interfere with or disrupt the Service or its infrastructure; (d) attempt to access another user's account or data; or (e) reverse engineer the app except where the law permits.

10. Intellectual Property

The Service, including its software, design, text, and branding, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. Settlement information summarized in the Service is drawn from public sources.

11. Third-Party Sites and Services

The Service links to third-party websites, including settlement administrators' filing pages, and relies on third-party providers (such as Apple for payments). We do not control those sites and services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SETTLEMENT INFORMATION IS COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST PAYOUTS, OR MISSED SETTLEMENT DEADLINES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR FIFTY U.S. DOLLARS ($50), WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service, including any claim you file with a settlement administrator.

15. Changes to the Service or These Terms

We may modify or discontinue the Service at any time. We may update these Terms from time to time; the effective date above reflects the latest revision. Material changes will be communicated through the app or this site. Continuing to use the Service after changes take effect constitutes acceptance.

16. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including Sections 3, 12, 13, and 14) survive.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, and any disputes will be resolved in the state or federal courts located in California, unless the law of your place of residence requires otherwise.
